Code Enforcement Board

The Code Enforcement Program is mandated by Chapter 162 of the Florida Statute. The Code Enforcement Board shall enforce and have jurisdiction to enforce all technical codes in force in the town, including but not limited to, occupational license, fire, building, zoning and sign codes.

Additional Information

Enforcement of the Town Code in Highland Beach is the duty of the code enforcement officer. If violations of the code or any ordinances are found, the code inspector notifies the violator by issuing a citation, and gives the violator a reasonable period of time to correct the violation.

Should the violation continue beyond the time specified for correction, the code enforcement officer may utilize whatever powers are available to him under the town building code and related codes or may notify the enforcement board or the special magistrate and request a hearing pursuant to the procedure in section 2-115.

If a formal hearing of a case is scheduled, the Code Enforcement Board has the authority to subpoena alleged violators, witnesses and evidence to appear before him/her. Cases are presented by the Town attorney or a member of the administrative staff, testimony is taken under oath, and at the conclusion of the hearing, the Code Enforcement Board has the authority to issue orders commanding whatever steps are necessary to bring a violation into compliance. Appeals of a final administrative order of the Code Enforcement Board may be filed to the circuit court.
