Development Project at 3822 S Ocean Blvd.

You may notice that, as you drive south past Toscana, an area of mangroves has been cleared. Town staff met with the property owner, who provided approved permits from the South Florida Water Management District and the U.S. Army Corps of Engineers authorizing the clearing and filling of 0.808 acres (approximately 300' x 137') of mangroves in connection with a proposed nine (9) unit townhome development. The property owner has not submitted plans to the Town/Planning Board for the proposed development or for the proposed seawall construction and the placement of fill, but they do intend on following all Town development procedures and regulations while proceeding with additional mangrove clearing (the property is entirely mangroves) as authorized by the approved permits. Florida law dictates that the State preempts local governments from requiring permits or taking actions that interfere with mangrove trimming/clearing activities that are authorized under applicable state and federal permits., meaning the Town will have to allow the permitted mangrove clearing to proceed. Staff will continue to require review and approvals for any seawall, fill placement, and development construction.
